Description :
In international armed conflict, the Geneva Conventions, adopted by all States, require states to treat military and civilian detainees with humanity and contain detailed rules regulating their detention. They also require States to give the International Committee of the Red Cross (ICRC) access to all civilian and military detainees to ensure that they are being treated in compliance with international humanitarian law (IHL). IHL also requires States to collect and transmit information on prisoners of war and civilians detained due to conflict to ICRC’s Central Tracing Agency. By accounting for those in the hands of belligerents, the Geneva Conventions aim to provide information to their families and to prevent their going missing. Parties to the conflict may also ask the ICRC, as a neutral intermediary, to facilitate the release of prisoners of war (PoWs) and other detainees by ensuring their safe transfer. The ICRC, however, can only support states to fulfil their obligations under the Conventions if they fulfil their responsibility to give it access to place of detention. Even though parties are legally required to do so, the reality is that more needs to be done so that this is done systematically.
