Description : The expert panel discusses the legal and practical challenges posed to IHL's scope of applicability and provide reflections forward for the regulation of modern warfare.
The increasing complexity of armed conflicts has solicited a number of debates on the scope of applicability of international humanitarian law (IHL). Conflicts such as those in Afghanistan, Iraq or Somalia have implications that reach far beyond their borders – and the pursuit of the ‘war on terror’ by military means has given rise to concerns over the emergence of a ‘global battlefield’, governed by IHL. How to categorize distinct international and non-international armed conflicts and which status and level of protection give to the various actors involved are central matters. Finally, the interplay between IHL and other bodies of law, such as human rights law, continues to have practical consequences for military operations.
The expert panel will discuss the legal and practical challenges posed to IHL’s scope of applicability and provide reflections forward for the regulation of modern warfare.
